Botswana : COA to decide PPADB's right to refuse to award tender to ZAC CONSTRUCTION CO.

The Court of Appeal (COA) will issue its ruling on February 5 if the Public Procurement and Asset Disposal Board (PPADB) was right in refusing a millions of Pula tender award to Zac Construction Company. The PPADB approached the COA after the High Court nullified its decision to refuse an infrastructure development contract worth P330 million to Zac for the Ministry of Lands in Metsimotlhabe Block 4.
The COA was told, on Tuesday this week, that the PPADB defied a proposal by the ministry to offer the work to the company on the grounds that none of the bidders had fulfilled all the needs of the Invitation To Tender (ITT).
The High Court had asked to offer the tender to Zac, in October 2014. The court stating that it was not appropriate for the PPADB to scrap the offer after engineers from the ministry in conjunction with consulting engineers had jointly viewed Zac as compliant in all respects. Following the ruling, the PPADB approached the COA calling Zac's appeal for judicial review at the High Court as premature.
