India : MADRAS HC comes down upon district administration over tender process

The Madras High Court Bench has heavily criticized the Dindigul district administration for not following the terms of Tamil Nadu Transparency in Tender Rules, 2000, while inviting bids to open shops and entertainment galleries behind Kottaimariamman Temple during the Masi festival to be held from February 12 to March 3.

According to Justice B. Rajendran, "The respondent (Dindigul Collector) shall keep in mind that every penny collected by way of contract is revenue for the government and the said amount is spent for the welfare of the people at large and prosperity of this country. This court cannot shut its eyes to the action of awarding tenders in a casual manner like the case on hand."

The observations were made while disposing of a writ appeal submitted by a failed bidder who said he was ready to offer Rs.25 lakh for the contract. However, the officials had decided to award it to an individual who had offered just Rs.20.05 lakh.

The judge, found force in his contentions, and quashed the tender notification released by the Collector on 31st December.

He noted that the Collector had given just eleven days time to submit tender though the Tamil Nadu Transparency in Tender Rules mandated grant of 15 days. The time limit could be decreased only if had been approved by an authority higher than the tender inviting authority for reasons to be recorded in writing.

But no such approval was received in the current case.
