United Kingdom : Farry launches public consultation on tribunal rules and procedures

These tribunals provide a legal means of dealing with disputes at work. Commenting on the consultation, Minister Farry said: "Most problems at work don’t require a legal solution and can be resolved either through dialogue in the workplace or with the assistance of the Labour Relations Agency. It is right that people try to deal with disputes as early as possible in most situations, before matters escalate and employment relationships begin to break down.

"But it is important that people continue to have access to legal redress through a tribunal, so that those who infringe employment rights protections can be held to account.

"The purpose of this consultation is to seek views on proposals to update rules, procedures and guidance to ensure that the tribunals continue to provide a fair, accessible and efficient service to those who need it." The rules have been restructured and simpler language has been used where possible.

The consultation, which will run for 12 weeks, asks for feedback on updated regulations and procedural rules and on how associated information and guidance materials can be developed to ensure that people have a clearer understanding of what they can expect from a tribunal and what they will need to do to present their case effectively.

The proposals include legislative support for early case management to assist parties to prepare for their case and gain an appreciation of the potential issues they will need to consider in taking it forward.
