India : Govt. approves land procurement policy

The government has passed the state land procurement policy drafted under the provisions of the Section 107 and Section 108 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, which will allow acquisition of identified lands after receiving the voluntary consent of the private land owners, subject to the payment of all his or her due entitlements, which are provided under the 2013 Act.

The policy passed by the state cabinet on Friday would be valid for lands to be utilized for only public projects as undertaken by the government, and not for any private projects which includes those under public-private partnership.

Chief Secretary R K Srivastava said the cumbersome land purchase exercise has now been simplified by leveraging the provision in the central legislation which allows the state government to enter into some sort of acquisition of land from a private owner, after receiving his voluntary consent, subject to all his due entitlements, which are provided under the 2013 Act.

He said,"The extensive time usually taken for the process of land acquisition by the government would now be substantially reduced, and could be as short as say, three months."
