United States: U.S. Wins Bid for Court Rehearing in CIA Torture Suit

A U.S. appeals court agreed to reconsider the government’s national security objections to a suit alleging that a Boeing Co. unit disguised the delivery of suspected terrorists to secret prisons where they were tortured. A three-judge panel in April rejected a request by the Obama administration to throw out the case on grounds that state secrets would be jeopardized if it’s allowed to proceed. The Justice Department then requested a rehearing by an 11-judge panel of the U.S. Court of Appeals in San Francisco.
The appeals court agreed to hear the government’s arguments. In its request, the Justice Department relied on the same arguments the Bush administration put forth after the case was filed in 2007.
