India: HC Grants Interim Stay on Garbage Disposal Tender

The Karnataka High Court granted interim stay to the solid waste management and garbage disposal tender of Bruhat Bangalore Mahanagara Palike (BBMP). Granting the interim stay on a public interest litigation petition filed by a former Mayor and others, the division bench comprising and Justice, ordered issue of notices to the government and the Administrator of BBMP.
The petitioners submitted that the solid waste management and disposal of garbage, including manual sweeping, mechanical sweeping and door-to-door garbage collection was being done by the Corporation. It was wrong on the part of government to call for tenders when the corporation did not have an elected body and elections were due in a few months, they said. The petitioners contended that it was not permissible to take major policy decisions, that too involving financial outlay of Rs 1,000 crore.
